Thryvwell Pediatric Health, Inc. ("Thryvwell," "we," "us," or "our") operates the website thryvwellhealth.com and provides a telehealth program for pediatric weight management. This Privacy Policy explains how we collect, use, disclose, and protect information about you when you visit our site, submit a form, or use our services.

By using our website or services, you agree to the practices described in this policy. If you do not agree, please do not use our site or services.

1. Information We Collect

We collect information you provide directly to us, including your name, email address, phone number, your child's name and age, insurance information, and any other details you submit through our consultation request or referral forms. We also collect information automatically when you visit our site, such as your IP address, browser type, pages visited, and referring URL, through standard server logs and analytics tools.

We do not collect payment card information directly. Any payment processing is handled by a third-party payment processor subject to its own privacy policy.

2. How We Use Your Information

We use the information we collect to respond to your consultation or referral requests, schedule appointments, verify insurance eligibility, communicate with you about your child's care, send operational updates about your account or program, improve our website and services, and comply with legal obligations.

We do not sell your personal information to third parties. We do not use your information for targeted advertising.

3. Protected Health Information

When you or your child becomes a patient of Thryvwell, certain information you provide may constitute Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). We maintain a separate Notice of Privacy Practices that governs how we handle PHI. You will receive a copy of that notice at or before your first clinical visit. This Privacy Policy governs non-clinical information collected through our website and intake forms.

4. Information Sharing

We may share your information with service providers who assist us in operating our website and delivering our services, such as cloud hosting providers, email delivery services, and electronic health record platforms. These providers are contractually required to protect your information and may not use it for their own purposes.

We may share information with your child's referring pediatrician or primary care provider as part of coordinated care, with your consent. We may also disclose information when required by law, in response to a valid legal process, or to protect the rights, safety, or property of Thryvwell, our users, or the public.

5. Children's Privacy

Our services are directed at parents and guardians of adolescents ages 12 to 17. We do not knowingly collect personal information directly from children under 13 without verifiable parental consent. All intake information about a minor patient is collected from and with the consent of a parent or legal guardian. If you believe we have inadvertently collected information from a child under 13 without consent, please contact us at [email protected] and we will promptly delete it.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required by law. Consultation request and referral data is retained for a minimum of seven years in accordance with applicable healthcare recordkeeping requirements. You may request deletion of your information by contacting us, subject to our legal obligations to retain certain records.

7. Security

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, alteration, and destruction. Our platform uses encrypted connections (TLS) for all data in transit. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Your Rights

Depending on your state of residence, you may have rights to access, correct, or delete the personal information we hold about you. California residents have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect and how it is used, the right to request deletion, and the right to opt out of the sale of personal information (we do not sell personal information). To exercise any of these rights, please contact us at [email protected].

9. Cookies and Analytics

Our website uses cookies and similar tracking technologies to understand how visitors use our site and to improve the user experience. You can control cookie settings through your browser preferences. We use analytics tools to collect aggregated, non-identifiable data about site traffic and usage patterns. We do not use third-party advertising cookies.

10. Third-Party Links

Our website may contain links to third-party websites, including insurance carrier portals and patient assistance program sites. We are not responsible for the privacy practices of those sites and encourage you to review their privacy policies before providing any personal information.
