1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the services provided by Thryvwell Health LLC ("Thryvwell," "we," "us," or "our"), including our website, telehealth platform, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you are a parent or legal guardian enrolling a minor patient, you agree to these Terms on behalf of yourself and your child.

2. Eligibility

Our clinical services are available to patients ages 12–26 residing in all 50 United States. For patients under 18, a parent or legal guardian must consent to treatment and maintain an active account. We reserve the right to decline or discontinue services if eligibility criteria are not met or if continued treatment is not clinically appropriate. Service availability in specific jurisdictions may be subject to local licensing requirements.

3. Services Description

Thryvwell provides physician-supervised weight management services for adolescents via telehealth. Our services may include medical consultations, prescription management, laboratory monitoring, nutritional guidance, and digital health tools. Services are provided by licensed healthcare professionals.

Our Services do not replace emergency medical care. If your child experiences a medical emergency, call 911 or go to the nearest emergency room immediately.

4. Account Registration

To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Fees and Payment

Thryvwell operates on a monthly membership model. By enrolling, you agree to pay the applicable monthly fee as displayed at the time of enrollment. Fees are charged on a recurring monthly basis to your payment method on file.

  • Membership fee: Covers physician visits, care team support, platform access, and program services as described at enrollment
  • Medication costs: Prescription medication costs are separate from the membership fee and are the responsibility of the patient/family. We assist with manufacturer savings programs where available.
  • Laboratory costs: Lab work may be billed separately by the laboratory facility. Many labs accept insurance for lab work even when the clinical program is cash-pay.

6. Cancellation and Refunds

You may cancel your membership at any time by contacting us at hello@thryvwellhealth.com or through your patient portal. Upon cancellation:

  • Your membership remains active through the end of the current billing period
  • No further charges will be made after cancellation is processed
  • Refunds for partial months are not provided
  • Your care team will coordinate a safe transition, including medication taper guidance if applicable
  • Medical records remain available per our retention policy

We reserve the right to discontinue services if clinically indicated, in which case we will provide reasonable notice and transition support.

7. Telehealth Consent

By using our Services, you acknowledge that healthcare will be delivered via telehealth (video, phone, and/or asynchronous communication). You understand that telehealth has limitations compared to in-person care, including the inability to perform physical examinations. Separate telehealth consent is obtained during the intake process.

8. Prescription Medications

Prescribing decisions are made solely by licensed physicians based on clinical judgment. Enrollment in our program does not guarantee that any specific medication will be prescribed. Medications are prescribed only when clinically appropriate and after proper evaluation, including review of laboratory results.

You agree to use prescribed medications only as directed, report any side effects promptly, and attend all required follow-up visits for safe medication management.

9. Patient Responsibilities

As a patient/guardian, you agree to:

  • Provide accurate and complete health information
  • Attend scheduled appointments or cancel with reasonable notice
  • Complete required laboratory work in a timely manner
  • Follow treatment recommendations and report concerns promptly
  • Maintain a safe and private environment for telehealth visits
  • Notify us of any changes in health status, medications, or contact information
  • Ensure the enrolled minor participates in the program as directed

10. Intellectual Property

All content, materials, software, and intellectual property associated with our Services, including but not limited to our website, platform, images, photographs, illustrations, graphics, videos, text, educational materials, clinical protocols, branding, logos, trademarks, trade dress, and proprietary methodologies, are the exclusive property of Thryvwell Health, LLC (or its licensors) and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

The Thryvwell name, Thryvwell Health logo, V-leaf mark, and all related names, logos, product and service names, designs, and slogans are trademarks of Thryvwell Health, LLC. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this website are the trademarks of their respective owners.

All images, photography, illustrations, and visual content displayed on this website are either owned by or exclusively licensed to Thryvwell Health, LLC. Unauthorized reproduction, distribution, display, or transmission of any content on this website is strictly prohibited. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from any content without our express written consent.

11. Limitation of Liability

To the maximum extent permitted by law, Thryvwell Health LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

This limitation does not apply to claims arising from gross negligence, willful misconduct, or violations of applicable healthcare regulations.

12. Disclaimer

Our Services are provided "as is" without warranties of any kind, except as required by law. We do not guarantee specific health outcomes. Individual results vary based on adherence, biology, and other factors. Information on our website is for educational purposes and does not constitute medical advice until a provider-patient relationship is established.

13. Dispute Resolution

Any disputes arising from these Terms or your use of our Services shall be governed by the laws of the State of Georgia, without regard to conflict of law principles. You agree to first attempt to resolve any dispute informally by contacting us. If informal resolution is not successful within 30 days, disputes shall be resolved through binding arbitration in Fulton County, Georgia, except that either party may seek injunctive relief in court for intellectual property violations.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Material changes will be communicated to active members via email at least 30 days before taking effect. Continued use of our Services after changes constitutes acceptance.

15. Termination

We may suspend or terminate your access to our Services at any time for violation of these Terms, non-payment, or if continued treatment is not clinically appropriate. In cases of termination, we will provide reasonable notice and coordinate a safe care transition.
